1. Acceptance of Terms

By creating an account, accessing, or using the ROCS platform, software, storefront tools, kitchen display interfaces, or business dashboards (collectively, the "Service"), you agree to be bound by these Terms of Service. If you are accepting these terms on behalf of a restaurant, food establishment, or legal entity, you represent and warrant that you have full authority to bind that entity to these terms.

2. Regional Scope & Rollout Phases

ROCS is deployed via a phased rollout schedule across the United States:

• Phase 1 (Current): Services are currently available for commercial restaurant operators located and legally registered in the State of Washington.
• Phase 2 (Upcoming): Services will expand to food and beverage businesses across all 50 U.S. states and territories.

You agree not to attempt registration or operate the platform outside supported regions without prior written approval from ROCS.

3. Platform & Services Overview

ROCS provides point-of-sale, digital ordering, and operational tools designed for food service merchants, including:

• Customer Storefront: Online menu presentation, ordering flows, and real-time status updates for diners.
• Kitchen Display System (KDS): Order processing workflows and digital ticket queue management for kitchen staff.
• Business Dashboard: Restaurant administration, pricing adjustments, inventory monitoring, and sales reporting.

4. Merchant Accounts & Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to ensure that all menus, item pricing, tax rates, allergen disclosures, and business operation details configured on your ROCS account accurately represent your business and comply with local health and commercial laws.

5. Pricing, Subscriptions & Payments

ROCS offers recurring subscription tiers (including Starter at $19/mo, Pro at $49/mo, and Business at $99/mo). By selecting a subscription tier, you authorize us to charge your payment method on a recurring billing cycle.

Fees are billed in advance on a monthly basis. Payment processing fees incurred via customer orders placed on your storefront are subject to third-party payment gateway charges (e.g., Stripe) as detailed in your merchant dashboard. All fees are non-refundable except where required by applicable state law.

6. Acceptable Use & Conduct

You agree not to use ROCS for any unlawful activity, to process fraudulent transactions, to upload malicious code, or to bypass system security parameters. We reserve the right to suspend or terminate accounts that violate operating policies or engage in suspicious payment activities.

7. Intellectual Property Rights

All platform interfaces, software source code, designs, and branding associated with ROCS remain the exclusive property of ROCS and its licensors. You retain full ownership of all merchant content, logo assets, and menu graphics uploaded to your store instance.

8. Disclaimers & Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, ROCS disclaims all warranties, express or implied. In no event shall ROCS be liable for indirect, incidental, or consequential damages, including loss of business profit, store downtime, or data corruption.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in state or federal courts located in King County, Washington.

10. Termination & Modifications

You may cancel your subscription at any time through your Business Dashboard. We reserve the right to modify these Terms at any time by updating this page. Continued usage of the Service after changes are posted constitutes acceptance of the revised Terms.
